JUDICIAL SERVICE

Serving Since 2004

Judge Skahan is known for her temperament and thoughtful decisions. She signed an order in November 2021 vacating Pervis Payne's  capital sentence. This came after the Shelby County District Attorney's office announced it was dropping its pursuit of the death penalty against Payne after a state expert examined Payne and his records  "and could not say that Payne's intellectual functioning is outside the range for intellectual disability,"  Both the U.S. and Tennessee Supreme Courts have ruled that it is unconstitutional to execute someone with an intellectual disability.  Judge Skahan also ordered DNA testing on evidence from the crime scene.
